These Terms & Conditions ("Terms") govern your access to and use of the Hvayate platform, website and related services ("Service"). By creating an account or using the Service, you agree to these Terms.

1. About Hvayate

Hvayate is an online marketplace that connects students with independent teachers for live one-on-one and group classes. Hvayate is not a direct provider of educational services. Teachers on the platform are independent professionals responsible for the content, delivery and quality of their classes.

2. Eligibility

You must be at least 18 years old to create an account. Minors may use the Service only through a parent or guardian's account and with their supervision and consent.

3. Accounts

You agree to provide accurate information and to keep your login credentials secure. You are responsible for activity on your account.

4. Bookings and payments

• Students pay for sessions in advance through our payment gateway.
• Funds are held by Hvayate and released to the teacher only after the session is successfully completed.
• Hvayate charges a small commission per transaction, which is deducted from the teacher's payout.
• All applicable taxes, where required, are the responsibility of the relevant party.

5. Conduct of classes

Teachers are responsible for delivering the booked session at the scheduled time using the tools provided. Students agree to join sessions on time and behave respectfully. Hvayate may suspend accounts that breach these standards.

6. Cancellations and refunds

Cancellations and refunds are governed by our Refund Policy, which forms part of these Terms.

7. Acceptable use

• No illegal, harmful, abusive or infringing content or behaviour.
• No circumventing Hvayate to take bookings or payments off-platform.
• No sharing of account credentials or impersonation of others.

8. Intellectual property

The Hvayate brand, website and software are owned by Hvayate. Class materials remain the property of the teacher who created them, subject to licences granted on the platform.

9. Disclaimers

The Service is provided "as is". Hvayate does not guarantee learning outcomes or the conduct of any individual user. To the maximum extent permitted by law, we disclaim implied warranties.

10. Limitation of liability

To the maximum extent permitted by law, Hvayate's total liability for any claim arising out of or relating to the Service is limited to the amount paid by you to Hvayate in the three months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service if you breach these Terms. You may close your account at any time by contacting support.

12. Changes to the Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
